THE LAW ON APPROVAL OF THE PROTOCOL 15 AMENDING THE CONVENTION FOR THE PROTECTION OF HUMAN RIGHTS AND FUNDAMENTAL FREEDOMS

The law on approval of the Protocol 15 amending the Convention for the Protection of Human Rights and Fundamental Freedoms has been published in Official Gazette numbered 29628 on 18 February 2016. This Protocol has been prepared on 24 June 2014 and aims to provide the effective functioning of the European Court of Human Rights. The major points of the Protocol 15 are such as follows:

  • Regarding the protection of human rights, the national mechanisms are primary, the Convention system is secondary and the countries possess a certain right of

  • According to the amendment in Article 21, the judges of the European Court of Human Rights shall not be over 65 years

  • Pursuant to the amendment in Article 35/1, the application to the court shall be made within 4 months instead of 6 months from the exhaustion of domestic
  • In consequence of the amendment in Article 35/3/b, the way is eased for bringing the important cases to the Grande
